Official Rules for Loot-Of-The-Week

By entering the Loot-Of-The-Week sweepstakes, you agree to abide by all
terms of the following Official Rules, which shall be final.
ELIGIBILITY
The Loot-Of-The-Week sweepstakes at the
is open to individual users who have registered as members of the
. Membership is free but is only open to people who live, work or have an

In addition to the Vibary membership requirement, this sweepstakes requires that users
have legal United States residency and be at least 18 years old.
Employees and their immediate families (parents, spouse, siblings, and children)
of Viba Fima and its agents and subsidiaries are not eligible to enter.
Employees and their immediate families of the prize Sponsors and their subsidiaries,
agents and affiliated businesses are also not eligible.
Your eligibility to enter the Loot-Of-The-Week sweepstakes may be withdrawn
due to Bad Conduct. PURPOSE
The purpose of the Loot-Of-The-Week sweepstakes is to allow you, as a member of
the Vibary to sign in to the Member-Only area of the Vibary (the "Member
Hub"), while automatically gaining an additional chance to win one of the
promotional prizes ("Loots") offered by Viba Fima and other prize
Sponsors. If you do not want to play, you can still sign in to the Member Hub by
clicking the 
icon. If you are not a member or are a member but prefer not to identify
yourself for this browsing session, you can enter the public area of the Vibary
(the "Public Hub") by clicking 
,
bypassing this chance to win.
HOW TO PLAY
All the Loot prizes are displayed on the sign-in page of the Vibary. Every week,
there will be several Loot prizes from which to choose. Selecting a Loot prize means moving
the mouse cursor on top of its picture and clicking the mouse button for
selection (usually the leftmost button). If within the current browser
session, you have not previously signed in as a member, a sign-in window will
pop up asking you
to enter your username and password. If you are a member of the Vibary, you can
enter this information. Upon verification, you will enter the
Member Hub of the Vibary. At the same time, you will automatically get an
additional chance to win the selected prize. If you have already signed in during
this browsing session, you have already authenticated yourself and no sign-in
window will pop up. You will enter the Member Hub, and gain an
additional chance to win the selected Loot prize, unless you fail the Home Vibary
requirement or the time limitation.
HOME VIBARY REQUIREMENT
If you are a member of another Vibary, you can use Loot-Of-The-Week of the
to sign in and gain access to the Member Hub. However no additional chance will be granted to
you, since Loots of the
are reserved to the members of the
. Vibary members can only play Loots-Of-The-Week at their home Vibary.
TIME LIMITATION
Every 4 hours, you have a new opportunity to select a Loot prize from the Vibary sign-in page and
gain a new chance to win. For example if you have
successfully selected a Loot prize at 6:20 a.m., you will have a chance to select
another Loot prize (the same one or a different one) only 4 hours later, at 10:20
a.m. Before that time, you can still select a Loot prize to get back to the Member Hub
page, but no additional chance to win the selected Loot is credited to you. The
time limitation is associated with your username. It does not depend on the
browsing session, nor the computer you use to select the Loot. For example, if
you use a computer at home to successfully select a Loot prize, and then use a
computer at school or work to select another prize before the time limitation
expires, you will not get a new chance (assuming that you use the same username). The time limitation
runs continuously until it is reset. It is only reset at the first minute past
midnight of
every Monday, when the previous week's Loot-of-The-Week sweepstakes has ended and the new
week's Loot-of-The-Week sweepstakes begins. RUNNING PERIOD
The Loot-Of-The-Week sweepstakes runs every week, from the first minute of
Monday to the last minute of the following Sunday. If there are
no Loot Sponsors for a certain week (including Viba Fima as a Sponsor), then the
Vibary will not offer the Loot-Of-The-Week sweepstakes for that week.
DRAWING
After a Loot-Of-The-Week is closed at the last minute on Sunday, the Vibary will
run a random drawing computer program (the "Drawing Program") to
select the winner of all the Loot prizes offered in that sweepstakes. The Drawing
Program is designed to run unattended and automatically. If there is a glitch
(software or otherwise) in the Drawing Program, all the entrants and supposed
winners shall be bound by the Limitations of Liabilities.
The Drawing Program is scheduled to run within 24 hours after the close of a
Loot-Of-The-Week sweepstakes. However, in the case of extraordinary circumstances, the
running of this program may be delayed or cancelled. The extraordinary circumstances include
the unavailability of the computer to run the program, the detection of fraud
and other things as
described in the Limitations of Liabilities.
ODDS OF WINNING
The odds of winning each offered Loot prize depends on the number of times (the
"Picks") other Vibary members have selected that particular Loot, and
the number of times you have selected that Loot yourself. The more Picks you
have for that Loot, the more chances you have of winning that Loot. The more
Picks other members of the Vibary have on that same Loot, the less chance
you have of winning it.
If you look in your own Loot Bag,
you'll find the total Picks for each Loot prize, the total Picks you have for
that prize and the calculated odds of you winning.
ANNOUNCEMENT OF WINNERS
Winners are notified as soon as the drawing is completed. All winners will be posted in the Past Drawings
page. Winners will also be notified by e-mail if they have provided
their e-mail address as part of their membership information. You, as an entrant to the Loot-Of-The-Week sweepstakes, have
the sole responsibility to maintain the optional
e-mail address for your membership. Viba Fima and its affiliates are not
responsible to reach potential winners beyond the e-mail notification
described above.
PRIZE CLAIMING
When you are contacted as a winner via email, you will be asked to supply the
street address to which you would like your prize claim voucher mailed.
Mailing is done via US mail. You have four (4) weeks from the date of this email
to reply. Afterward your prize will be forfeited.
The prize claim voucher contains the certificate you will need to claim your
prize from the sponsor. Please check your email notification for instructions
from the sponsor on claiming the prize.
All prizes (Loots) are of different values. Their values are solely estimated by
their Sponsors, as shown in the Past Drawings, This
Week and Future Drawings pages. The values are not
verified by Viba Fima nor by any independent parties, and may not reflect the
prices that you can find on the market for the same or similar products or
services.
No substitution or transfer of prizes permitted by winners. Taxes, if any,
are the winners' responsibility.
LIMITATIONS ON LIABILITY
- All Loot prizes are awarded by the corresponding Sponsors. Viba Fima and its
Vibary affiliates only act as a conduit for businesses, and are not responsible
for the descriptions, valuations and subsequent awarding of the Loot prizes, unless Viba Fima and its Vibary affiliates are
the Sponsors of the selected Loot. If an external Sponsor reneges on the prize
or delivers a prize different than what was advertised on the Loot-Of-The-Week
page, as the potential winner, your only recourse is to bring the dispute to
the external Sponsor directly.
- Viba Fima and its Vibary affiliates are not responsible for any incorrect
and/or inaccurate information, for any human error, technical malfunctions,
lost/delayed data transmission, omission, interruption, deletion, defect,
theft or destruction, unauthorized access to, or alterations of, information
and other entries, for failures on the connection lines, equipment and
services that prevent Vibary members from participating in the Loot-Of-The-Week
sweepstakes.
- The Sponsors (including Viba Fima and its Vibary affiliates) are not
responsible for any injury, damage or loss that may happen to the winners when
using the awarded prizes. If the prizes are directly manufactured by the
Sponsors (for goods) and/or directly provided by the Sponsors (for services),
then the liability of the Sponsors are limited to the Terms of Usage and other
legal notices about using the goods or services, and to existing consumer
protection laws.
- If for any reason Viba Fima's Drawing Program is not capable of running as
planned, including infection by computer virus, bugs, tampering, unauthorized
intervention, fraud, technical failures or any other causes beyond the control
of Viba Fima and/or its Vibary affiliates which corrupt or affect the
administration, security, fairness, integrity or proper conduct of the
Loot-Of-The-Week sweepstakes, Viba Fima and its Vibary affiliates reserves the
right at their sole discretion to take as much time as needed to resolve the
issues, and to
resume the running of the Drawing Program when the issues have been deemed satisfactorily fixed. If this is not possible, Viba Fima and its
Vibary affiliates can at their sole discretion cancel the drawing.
- YOU AGREE TO ABSOLVE VIBA FIMA AND ITS VIBARY AFFILIATES FROM ANY
LIABILITIES RESULTING FROM PROBLEMS YOU MAY HAVE FROM GETTING OR USING THE
PRIZES FROM EXTERNAL SPONSORS.
IF THE PRIZES ARE SPONSORED BY VIBA FIMA AND ITS VIBARY AFFILIATES, YOU
AGREE TO ABSOLVE VIBA FIMA AND ITS VIBARY AFFILIATES FROM ANY LIABILITIES
RESULTING FROM PROBLEMS YOU MAY HAVE FROM USING THE PRIZES.
- The Loot-Of-The-Week sweepstakes is governed by the laws of the state of
, in accordance with the laws of the United States.
DISPUTES
As an entrant to the Loot-Of-The-Week sweepstakes, you agree that:

any disputes about the description and awarding of the prizes from external
Sponsors are to be resolved with the external Sponsors directly. The involvement
of Viba Fima and its affiliates will be limited to providing the records to any
asking parties for them to build their cases

any other disputes, claims, and other causes of action arising with this
sweepstakes, shall be resolved individually,
without resort to any form of class action
-
if such resolution cannot be attained amicably, such disputes, claims and causes shall be resolved
in a federal or state court located in the state of
having competent jurisdiction

any and all claims,
judgments, and awards shall be limited to actual out-of-pocket
costs incurred, including costs associated with entering this
Sweepstakes, but in no event attorneys' fees
-
hereby waive all rights to claim, punitive,
incidental, and consequential damages, and any other damages,
other than for actual out-of-pocket expenses, and further waive
all rights to have damages multiplied or increased.
PRIVACY NOTICE
The Loot selections that you made may be used by Viba Fima in its
One-Minute-A-Week newsletter. This weekly newsletter highlights products and
services from local and national merchants and businesses that may be of
interest to you. Complete details on this program can be found on the Privacy
Policy of the Vibary.
If you are a potential winner, Viba Fima, its Vibary affiliates, and
the external Sponsors have the right but not the obligation to use and publish
your username and your winning Loot, online and in print, or any other media,
present and future, without any additional compensation to you, but only in
connection with the Loot-Of-The-Week sweepstakes.
You may also be asked to let Viba Fima, its Vibary affiliates, the external
Sponsors and their advertising and promotional agencies use your picture, proper
name and likeness for advertising and promotional purposes, without additional
compensation, unless prohibited by law. You have the right to refuse such
request.
BAD CONDUCT
You will be disqualified from winning a Loot prize and may become ineligible to enter
future Loots-Of-The-Week sweepstakes if you have been found to:
- tamper with the entry process or the operation of the Loot-Of-The-Week
sweepstakes
- use robotic, automatic, programmed and other non-human method to enter
- be acting in a non-sportmanlike and disruptive manner, or with intent to
annoy, abuse, threaten or harass any other person
- act in violation of these Official Rules in particular and the Terms
of Usage in general.
CHANGES AND NOTICES
Viba Fima and its Vibary affiliates reserve the right to cancel the
Loot-Of-The-Week sweepstakes at any time without the obligation to provide
another promotion in its place. A notice will be published to the Vibary
Bulletin. Viba Fima and its Vibary affiliates reserve the right to change and
amend these Official Rules at any time. A notice will be published to the Vibary
Bulletin. To stay up to date, you agree to check the Vibary Bulletin for change
notices. Changes are effective on the date the notice is first
available, or on the date specified in the notice if later. YOUR SELECTION OF A
LOOT PRIZE AFTER ANY SUCH CHANGE IS YOUR AGREEMENT TO THE CHANGE.
